Waxwall Terms of Use and Community Guidelines

By creating an account or using Waxwall, you agree to these terms and to Apple's Licensed Application End User License Agreement. If you don't agree, don't use Waxwall.
1. Who can use Waxwall
- You must be at least 13, or the minimum age to use online services without parental consent where you live, if that is higher.
- You are responsible for your account, and you must keep your password private.
- One person per account.
- Don't create accounts to get around a block or a suspension.
2. Your content
Your content stays yours. Your content is your profile, wall, lists, posts, comments, collector notes and jacket photos. You keep ownership of it.
To run Waxwall, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, resize, display and distribute your content inside Waxwall. Public content can also appear in other users' feeds, walls and jacket galleries. This licence ends when you delete the content or your account, except:
- for copies others have already received, such as a cached image, and
- where we must keep something to resolve a report or meet a legal obligation.
Jacket photos.
- "Scan your copy" is for photos you take yourself of a record you own. Don't photograph a screen, a printout or an image you found online.
- A shared jacket photo is a photo of a published album cover. Its artwork belongs to its rights holders, and Waxwall shows it to identify the record.
- You can delete your photo at any time.
You are responsible for what you post. Only post content you have the right to share.
3. Community guidelines
Waxwall is for people who love records. There is no tolerance for objectionable content or abusive users. Don't post, send or upload anything that:
- harasses, bullies, threatens or intimidates anyone, or encourages others to;
- attacks people based on race, ethnicity, national origin, caste, religion, sex, gender identity, sexual orientation, disability, serious disease or age, or uses slurs or hateful symbols;
- is sexually explicit, involves nudity, or sexualizes minors in any way (we report child sexual abuse material to the authorities);
- glorifies or promotes violence, self-harm, suicide, terrorism or dangerous acts;
- is spam, a scam or misleading, or impersonates a person, artist, label or organisation (including Discogs);
- shares someone's private information without permission;
- infringes someone's copyright, trademark or other rights;
- is illegal, or promotes illegal goods or activity.
Album artwork can be provocative, and sharing a real record jacket is fine. Using it to harass someone or to post sexual content is not.
4. Reporting, blocking and how we respond
- Report:
- Posts and comments: tap ⋯ on the post or comment.
- Profiles: tap ⋯ on the profile.
- Jackets: tap Report in the jacket gallery.
- Block: use the same menus. Blocked accounts can't see your profile, posts or comments, and you won't see theirs. Manage blocks in Settings → Privacy & safety → Blocked accounts.
- We review reports within 24 hours. We may hide content while we review it. We may remove content and warn, suspend or permanently ban accounts that break these terms. Serious or repeated violations lead to a ban.
- Appeals: if we removed your content or suspended your account and you think we got it wrong, email support@waxwall.app.
5. Copyright complaints
If you believe something on Waxwall infringes your copyright, email us a notice with:
- the work
- where it appears in Waxwall (a screenshot or the profile handle helps)
- your contact details
- a statement that you have a good-faith belief the use is unauthorized
- a statement, under penalty of perjury, that your notice is accurate and that you are the owner or are authorized to act for them
- your physical or electronic signature
Send copyright notices to support@waxwall.app with "Copyright notice" in the subject.
We remove infringing material and terminate repeat infringers. If your content was removed and you believe that was a mistake, you can send a counter-notice to the same address.
6. Data sources and third parties
- Waxwall shows album information from MusicBrainz (CC0), cover images from the Cover Art Archive, artist photos from Wikimedia Commons, and, when available, links to Apple Music and Spotify and song previews from Apple.
- Discogs: "This application uses Discogs' API but is not affiliated with, sponsored or endorsed by Discogs. 'Discogs' is a trademark of Zink Media, LLC." Data from Discogs is marked "Data provided by Discogs" with a link to its source page. Connecting your Discogs account is optional and also subject to Discogs' terms.
- Waxwall is not affiliated with Apple, Spotify, MusicBrainz, the Internet Archive, Wikimedia or any artist or label.
- Catalog data comes from community databases and can be wrong or incomplete.
7. Using Waxwall fairly
Don't:
- scrape Waxwall
- overload it or probe its security
- reverse-engineer it
- get around rate limits or blocks
- use it to build a competing database
We may change, pause or end features. Waxwall is currently free.
8. Ending your account
You can delete your account at any time in Settings → Account → Delete account. We may suspend or end accounts that break these terms. Sections 2 (as it applies to content already shared), 5, 9 and 10 continue to apply after your account ends.
9. Disclaimers and liability
- Waxwall is provided "as is" and "as available".
- To the extent the law allows, we disclaim all warranties, and we are not liable for indirect, incidental or consequential damages or for lost data.
- Our total liability is limited to the greater of USD $50 and what you paid us in the last 12 months.
- Some places don't allow these limits, so they may not apply to you.
10. Disputes and changes
- These terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules.
- The state and federal courts located in New York have jurisdiction, unless your local consumer law gives you the right to sue where you live.
- We'll post changes here and update the effective date, and we'll tell you in the app about material changes. Continuing to use Waxwall after a change means you accept it.
11. Apple-specific terms
- These terms are between you and us, not Apple. Apple is not responsible for Waxwall or its content.
- Apple has no obligation to provide maintenance or support.
- Apple is not responsible for any product claims or third-party intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
- You confirm that you are not in a country subject to a US Government embargo and are not on a US Government list of prohibited or restricted parties.
